DRC · Mining
What an investor should review before signing a mining agreement.
Three clauses, one persistent issue and the question committees too often overlook.
A mining agreement requires two readings: one as a legal document, another as a description of what will happen on the ground.
The central question is intent. Exporting, partnering and establishing operations create different exposures, so the same clause cannot carry the same weight.
The practical conclusion is to review the agreement against the actual level of commitment and record what could not be verified.
